A WARNING TO CHERYL REINHARDT WHO IS HIS NEWEST VICTIM!

Jeff Marchand proposed a 1/2 and 1/2 ownership on foals born in 2009 on the terms I breed, maintain care of and attend vet and farrier visits. starting June 2008

I did that for one year (June 2008 to July 2009).

During that time he removed a mare LEOS MISS CRICKET and sold her. I was entitled to 1/2 ownership of the foal . I received nothing!

We had to destroy his badly neglected mare (MISS WIMPY) and I lost the 1/2 ownership on that foal also.

He did not honor the contract and verbal agreements we had. The terms of the contratct stated he would replace any mare with another if one was removed from the ranch.

He currently has his horses and has not paid me any of the entitlement of ownership of LEOS MISS CRICKET 2009 foal. Or the loss of MISS WIMPY's expected foal.

BEWARE OF HIS BUSINESS PRACTICES!

His stallion partnership in Bakersfield with his "Patriot King" bred horse and some mares resulted in the same problem.

He had to bring the sheriff to collect his horses from there and then cheated that partner out of the earnings entitled to him.

Turns out MARCHAND can't get along with anyone on his business dealings due to his breaches of contract- he makes a habit of.

This was MISS WIMPY upon her arrival. This is another one of his neglected horses...

Unfortunately she was so bad the vet (Dr AMARAL) recommended her to be put down (in July and Jeff refused and requested more time to try to get a foal) After several months of Dr Amaral's

recommendation being ignored by Jeff I finally put my foot down about it. I stood firm that he euthanize her for her own "pain relief"...so she was in Nov 2008.

Sadly she could hardly walk (notice her heels are not there from so many years of neglect) and Jeff wanted me to breed her to HANK!

I refused to and had the vet come and put her down. His greed to be "cheap" hurts the horses and his credibility /respect from his partnerships and he does not care.

BREACHED CONTRACT BY JEFF MARCHAND WILL BE HEARD IN CALIFORNIA COURT.

Proposal for limited partnership on production of registered quarter horse foals


General-
The basis of the arrangement is for me to run my mares and stallion at a ranch where I will not be charged stall or pasture fees. In return you may breed all of your mares to my stallion, share a major portion of outside breeding fees, and own 50% of the foals out of my mares born at your ranch.


Mares-
You agree to provide housing, pasture and daily care for my mares.
I agree to pay actual monthly feed costs for the mares, as well as normal non-breeding vet fees, and farrier fees.
You agree to pay 50% of breeding specific vet fees on mares from which we will split foals; for instance, ultrasounds, pneumobort shots, and any insemination fees by mutual agreement.
I will retain ownership of my mares. You retain ownership of your mares.
I agree to transfer all foals out of my mares into the name of a partnership created by you and me.
I reserve the right to breed one of my mares per year to an outside stallion of my choice and retain 100% ownership in the resulting foal. The purpose of this is to develop new broodmares. In exchange you may choose any other foal and retain 100% ownership. The remaining foal(s) from that year will be partnership foals.
I reserve the right to swap out or replace one mare per year in order to better suit the stallion if necessary.

Stallion-
You agree to provide housing, pasture, daily care and exercise for my stallion at no charge to me.
I agree to pay actual monthly feed costs, normal vet fees and farrier fees.
I retain ownership of the stallion.
I will pay all full-time training costs of the stallion if I put him into training or showing.
You may breed all of your mares to my stallion at no charge and I agree to sign the stallion breeding report.
I reserve the right to offer one free breeding to an outside rancher in an effort to promote the stud.
I agree to promote the stud and foals by maintaining a website at my own cost, and advertising in print a minimum of $350 per year. If you wish to advertise more, the amount over $350 will be split 50/50.
I reserve the right to rotate or replace the stallion with another of my stallions after the breeding season.
If I send the stallion out to jackpots, I keep any earnings. If you jackpot off of the horse, by mutual agreement, you keep 75% of the earnings and apply 25% of the earnings to my feed costs.
If we sell more than two outside breedings per year, I may keep 100% of the proceeds of the third breeding in order to offset advertising and feed costs. The remaining breeding sales will be split between us.

Foals-
As soon as a foal is born it is a partnership foal and all costs of raising the foal will be split equally between us. All income from sales of partnership foals will be split equally between us.
Except as noted above where I may retain 100% ownership of a foal, foals will be considered partnership foals in the aggregate, not as individuals. So that rather than us each picking ownership of foals from crops, they all become foals owned by our partnership and the costs and profits of them as a group are borne by both of us.

Termination-
If you choose to end this arrangement you agree to give me six months notice. If it occurs that the time you want my mares moved they are pregnant then the resulting foals will not be partnership foals but will be retained 100% by me.
If I choose to end this agreement I agree to give you six months notice. If at the time I move my mares any mare is pregnant then the resulting foals will be partnership foals.
Except by mutual agreement I agree to make every effort to have all partnership foals born and weaned at your ranch before termination of the agreement.

Misc-
Any incidental costs not outlined above will be dealt with by mutual agreement. Such costs might include hauling to vet, etc. Hopefully as my partner you will keep in mind the enormous expense I have incurred in shipping my horses to your ranch to begin this partnership.
